Wilks and Dunn v. Phelps Dodge Miami, Inspiration Copper and BHP Copper

With Kevin Hannon as lead counsel, Plaintiffs in this community with contaminated groundwater from copper smelter operations achieved a settlement valued at over $10.67 million.  The Wheatfields community near Globe, Arizona had been subject to years of toxic contamination of its drinking water supply from mining wastes generated from the operations of the Inspiration Copper Smelter. Contaminants of concern include manganese and cadmium.  The settlement in this class action case filed in United States District Court in Arizona, includes the establishment of a medical monitoring program, replacement of over 70 drinking water wells, a $3.45 million cash payment to the class, and additional sampling.
